Former Angel Drunken Murderer?

OK, so he only played like half of a season for the Halos, but Jim Leyritz was charged with DUI homicide for ramming what I can only imagine was his huge SUV into another car while he was drunk and killing the driver in the other car. I thought this was at least bigger news than Erstad moving to Houston (no offense, goat). Click the link for the story.

be hearing comment on every talk radio station in NY about the Yankees' wins, losses, new manager (who he used to back-up).

Second degree murder
if I had my way, getting behind the wheel of a car drunk and accidentally killing someone would be second degree murder.

I usually really hate blaming the victim at all
and this isn't an exception in the sense that the fault is with Leyritz...but if you don't wear a fucking seatbelt in this day and age, there's something just really, really, really wrong with you.

Leyritz is still at fault. You get behind the wheel of a car drunk, and you are endangering lives of not only every other driver on the road, but every pedestrian walking along your route. When I was in 3rd grade, my best friend was run down by a drunk driver. So I have no sympathy for anyone who shows that little regard for the lives of other people.

I'm just saying wear the freaking seatbelt, so in case you DO run afoul of something in your car, you've got a fighting chance of coming out alive.

sorry if it sounded like I was saying that I thought you were blaming the victim...that was just sort of my own personal aside.

I have some friends who don't like wearing seatbelts  (Mozilla's spell check doesn't recognize the word "seatbelts", but it recognizes "seatbelt") when we're in the car for whatever dumb reason.  Usually some bullshit about "comfort" and whatnot.  Needless to say, when I drive, I don't pull out of the driveway or parking lot until everyone has one on.  And I'm a pretty big dick about it.  The possible alternative is sort of...grim.

You assume...
...that the reason the victim was ejected was because she was not wearing her seat belt. I did not read in the article where it was found that she was not buckled up. Perhaps I missed that.

There is a known problem with "inertial unlatching" on side impacts, wherein the collision itself causes the seatbelt buckle latch to fail. If Leyritz went through a light and broadsided her Montero, then it is possible that she was doing everything right, and still her seatbelt failed and she was thrown from her driver's seat.

if it can be proved that the defendant had a subjective awareness of the danger of the situation. It's called a Watson murder. So, for example, if Leyritz did something to indicate that he was aware of his diminished capacity to drive before the accident happened, he could be prosecuted for murder on this basis.

You hit it right on...
A bill passed earlier this by the California legislature (AB 808) will require everyone who gets/renews their license to sign saying they acknowledge driving drunk is dangerous. This will fulfill the Watson warning, making it easier to convict people like Leyritz of second-degree murder...
