Yeah... HK tagged him out after he out ran 1st
but he moved toward second for a moment when he saw erv lose the ball.

Well, I cannot argue judgment. Mine would have been different.
I just ran the replay on the DVR. Upton was running directly up the foul line. In his final stride to touch 1B, Santana tries to catch the throw from Tex and step back to touch the bag, but he is still 2 feet down the line towards home from the bag itself. And his left foot is about to touch the foul line. This forces Upton to flail and hop to his left as his right leg must now go around Santana and reach back to touch the bag. Upton is now offbalance and runnign on the grass, wheras two strides earlier he was on the foul line. As Upton comes to a stop, his track takes him arcing from 1 foot on the grass, back to 6 inches on the infield dirt as he reaches the back of the infield. He stops, facing Kendrick who is in foul territory.
Yeah, it probably crossed his mind for a flash of a second, but weak sauce, man, weak sauce.

Here's the rule:

The umps interpretation is that starting to move towards second and the changing your mind IS NOT returning immediately to the base.
