No sitting jury or chambers trial judge in Oklahoma or Texas would give Gallo the slightest bit of empathy. In fact, both states have a death penalty and both administer it with a heavy hand when circumstances dictate. Only Boston or a Connecticut suburb might lighten Gallo’s destiny.

And he was driving his (or his parent's) minivan...

Which means he started off by driving to that party with a suspended license. And suddenly after he drives through a red light, speeding, into another car (or two) he has the presence of mind to run away from the cops. Twice. Yeah, such an accident.

was under the impression he couldnt afford an attorney. im guessing longwith took it at a reduced rate to get his name out into the media (high profile case and all).

you're completely right.

and it is not like his attorney will be standing up and preaching his client’s innocence to the court. he will fight for a fair trial, proper jury instructions, and try to explain why his client is guilty of the lesser included offense.

basically, he’ll try to reduce it from second degree murder to involuntary manslaughter.

   Screw the jerk. It aint like he was never told not to drink and drive. His freakin license was suspended! He just didn’t give a damn! I don’t much believe in shades of grey, or extenuating circumstances. He killed 3 people. He deserves no sympathy. Let him spend the next half century in a federal pen thinking about how he f*****d himself.

The guy even wrote out and signed a statement to the effect that he understood that by driving drunk he could seriously injure or kill someone.

I guess they didn’t make him write down the fact that he has no respect for human life though.

So he's--or his lawyer's--got the balls to plead not guilty????

Wow. Just wow. I don’t give a shit if he meant to do this or not—let that play a role in the sentencing. I’m sure he is a “nice person/good kid,” to some degree. And I’m sure he didn’t get behind the wheel that night saying to himself “man I’m gonna go kill me some people tonight.”

But what he did do was get behind that wheel knowing full well he couldn’t drive in that condition, knowing full well what could happen, knowing full well that he was running a HUGE risk—and yet he did it anyway. That’s literally the textbook definition of reckless homicide—second degree murder here in CA.

And now he’s going to go for not guilty? What an arrogant sob.

The arraignment was postponed today and continued to a later date.......

He did not make a plea today. My guess right now is plea bargain, but the OC DA is intent on prosecuting Gallo to the full extent of the law from what was said in the news conference.

But it’s more than obvious he’s going to go for a not guilty plea—referring to this as “an accident” and requesting a change of venue.

You don’t need a different venue to sign a guilty plea. You only request such a thing when you’re committed to going to trial.

The "it was an accident" defense won't fly because of his previous DUI history and the fact he was

under the influence at the time of this incident. He can plead not guilty all he wants, but if he and his lawyers go with this, he goes to jail for the rest of his life. If he pleads guilty, and they accept a plea bargain, he could get the sentence reduced and get out with at least a some years of his life left.

Gallo was warned that if he killed anybody while driving under the influence, he could be charged with murder.

Forgive me.

It used to be a private road, and the guy who names it wanted it to be the last address there is. It was later acquired by Cal State Fullerton and is their Desert Studies Center. I read about this as a student at CSUF and seem to have combined the facts in my head, as I usually do.

My point stands though that you can go to the ends of the earth and you’ll definitely find no sympathy there considering the victims of the crash.

I dunno if you can blame Mr. Longwith.

We all have the right to an attorney. And we all have the right to adequate representation. Even if Longwith thought that Gallo is the scum of the earth he’d have to do a good job representing him or HE could get sued by Gallo for inadequate legal counsel.

That being said I hope Gallo ends up getting castrated and beaned senseless with a baseball. It’s just hard for me to get mad at an attorney who’s trying to do his job.

It isn’t like this guy was assigned a case. And to be clear, I’m calling out Longwith in my sig, not Gallo. Everything everyone knows about the particular case is that a very drunk Gallo sped through a red light, destroying not only Nick Adenhart and Henry Pearson, but also a 20 year old CSUF Student, and internally decapitating another former CSUF Student who survives today only through the dedicated hard work of medical professionals. I’m sorry, but I also graduated with honors from CSUF and I have enough pride in my school and in my community that I tell Gallo to find himself another lawyer.

Not that I would find myself in that line of work to begin with. Because from what I can tell by reading Longwith’s website, he is in that line of work because he makes big bucks saving drunk drivers from being charged with expensive DUIs – and he does that by “expoiting” weaknesses in the methods used to prove the charges and confuse jurors into believing our police force doesn’t know what they’re doing. This is the same kind of bs “expoiting” of our legal system that let Lyman Bostock’s murderer right out of jail free after 21 months.

Yeah, hopefully Mr. Longwith will earn his reputation as a failure to help his clients at all after the court trial and eventual maximum sentence is hammered down.

It just makes me sick to think that someone with a degree from CSUF hanging on his wall has no qualms with taking this, of all cases.

Just from looking at his website, I can see how Mr. Longwith will tell the jury that the BAC levels the police obtained are inaccurate, because they were taken so long after his client was driving. Not that I see how it will help him to claim that his client soberly sped through a red light.

He’s already claiming that Gallo’s tears “speak volumes.” You know what they tell me? They tell me the same thing that this guy getting out of his car and fleeing tell me. This guy is looking out for himself, and is so upset to find himself in court being told that he’s facing so much prison time.

Anyway, yeah, I have no respect for this one DUI Lawyer.

is going to be crucified, both in public opinion and the legal system. Forever. He is going to be the poster child for what happens to drunk drivers when they kill.

He and his horribly deranged parents and relatives should suffer for eternity for what he did.

Let’s give him lethal injection or gas. I hear it takes a little while to die (so he will actually suffer more than if we cut off his head). Of course, only a handful of witnesses will get the pleasure of seeing him die instead of 55,000. I know a good one. Since we can’t execute his parents and uncle, the judge can just make them be part of the witnesses! That should punish them pretty good.

I’m still thinking about the stadium idea. We could sell tickets, make a fortune of concessions, and use the money to subsidize ticket prices for the rest of the season. Win/Win!

You can’t blame the parents for what their adult son did. The only way you blame them, or anyone else for that matter, is if they saw him get hammered and then not take his keys away. We are all responsible for our own actions, but also our own inaction when we don’t stop other people from doing stuff like this.

Anyway, a change of venue is probably for the best. It would still have to be in California for jurisdictional purposes. I think San Diego would probably be the best choice.
